1) All rents
are due and payable on the 1st day of each month. Any rent paid
after the 5th of the month will be assessed a $10.00 late charge.
There will be a $20.00 service charge on all returned checks.
Late paying habits will be a basis for termination of tenancy.
2) Payment
of rent may be made by mail and payable to Dante or Myra Broadway,
24 Shanna Drive, Weaverville, NC 28787
3) The minimum
rental period is one year. Tenant will be responsible for the
rent for the remainder of the lease if the property is vacated
before the end of one year, unless the property is rented. Then
the rent will be mitigated according to how much time lapsed between
the tenant's leaving and the new tenant moved in, the cleaning
costs, advertising costs and any damage done to the apartment
beyond normal wear and tear.
4) The tenant
is required to give 30 days notice. If you are unable to give
30 days notice, you will be responsible for 30 days rent from
the time of notice given. If you are unsure of the exact date
you will be moving, give us your best estimate, and most likely
we can continue to extend your lease past your notice and you
will have satisfied your notice.
5) We are
not responsible for tenants' personal property. We are not responsible
for any accident to tenant, his or her family or visitors. Visitors
should be in the company of tenant at all times and are subject
to the rules of the apartments when in tenant's property or in
public common areas.
6) Security
Deposits are not to be treated or considered as rent and are used
for the safekeeping of the living unit against damage which is
not considered normal wear and tear. Tenant is to return the apartment
to the same condition as when the lease was executed. At the Landlord's
discretion, charges which are made against tenant for services,
damages, legal and/or late fees or rent that are not immediately
paid by tenant may be levied against the Security Deposit.
7) No portable
heaters, kerosene or otherwise, are to be used in the units.
8) Quiet conditions
are expected at all times, day and night. Anyone not obeying this
rule will be warned. If tenant is given a second notice, they
will be requested to vacate his/her apartment. The tenant is responsible
for the conduct of guests and quiet conditions are expected from
them as well.
9) Disturbances
caused by the use of alcohol or drugs will not be tolerated. You
will be warned once for alcohol and the second time you will be
asked to leave. There is zero tolerance for illegal drugs.
10) No pets
are allowed. No visiting pets are allowed. You will be asked to
vacate the apartment if this rule is broken.
11) Each tenant
is to remove his/her garbage to the dumpsite which has been provided.
Garbage should not pile up inside or outside of the apartment.
No pasteboard can be put into the dumpster. You are responsible
for disposing of it.
12) No car
washing is allowed on the premises.
13) Only tenants
listed on the lease are allowed.
14) The landlord
is not responsible for any items stolen from the laundry rooms.
Tenants are responsible for cleaning up after use and locking
the rooms.
15) No changes
to the locks can be made without notification of the landlord.
If you need your lock changed, please contact the landlord and
he will change it. Tenant will pay a twenty-five dollar charge
for replacement of lock, unless it is due to a malfunction of
the lock.
16) Balconies
or patios may not be used for drying of clothes or other items.
17) Should
your marital status change, you are expected to notify the landlord.
18) If you
change jobs or telephone numbers, you must notify the landlord
of this change.
19) Any additional
drapery rods will be installed by the landlord.
20) All repairs
will be made by the Landlord. Cost of repairs from damage by the
tenant will be paid for by the tenant (other than normal wear
and tear). Service repairs requested by the tenant and preventative
maintenance work will be performed in the living unit whether
the tenant is home or not.
21) The landlord
will do all painting. No alteration of the unit will be permitted.
22) No inoperable
vehicle will be permitted to be stored or left standing or abandoned
on the apartment premises. All such vehicles will be towed away
at the owner's expense.
23) If a tenant
goes away overnight during cold weather, the heat must be left
on at 50 degrees Fahrenheit to keep the pipes from freezing.
24) Pictures
are to be hung with care. Ceiling hooks are NOT allowed. On paneling
walls, place all hangers in the paneling grooves.
25) Patios
and entries are to be kept clean by tenant. Tenant must cooperate
in keeping lawns free of unsightly trash, cigarette butts, etc.
"Junk" must not be left outside of the apartment back or front.
Use a mat outside of entrance to avoid excessive soil on the carpet.
If tenant desires to have carpet cleaned during tenancy, please
call the landlord for instructions.
26) Security
Deposits will be refunded within 30 days after termination of
tenancy. Once the unit has been vacated, the landlord will make
a physical inspection of the unit for damages that are not considered
normal wear and tear and determine what must be done to return
the premises to the same condition as when the apartment was rented.
27) If you
burn candles, use only the sootless kind.
28) We recommend
that you purchase renter's insurance. Our buildings are insured,
but your personal possessions are NOT covered under that.
