For mutual considerations received the parties of Dante & Myra Broadway as Landlord and ___________________________ as Tenant do hereby enter into this Residential Rental Contract pursuant to the terms and conditions specified herein.

| Lease Term |
The term is for one 12 month minimum which will begin on _____________________ and will terminate on __________________________.
|
Rental Payments |
Tenant(s) shall pay to monthly payments of $_________ due on or before the first day of each month. Non-payment of rent is a breach of this lease. No further notice is required for eviction. Based on the present rental rate, no additional improvements will be made at time of move-in. However if you desire a rental improvement; the rental rate can be re-negotiated to allow for the rental improvements of your choice. Rent may be mailed at the resident’s risk to 24 Shanna Dr. Weaverville, NC 28787. Prior experience indicated that rents should be mailed no less than 5 days before the due date. Any rents lost in the mail will be treated as unpaid until received.

Late Rental Payments |
A late fee in the amount of $_________ (5%) of the rental payment will be charged on the 6th day of each month of which the rental payment is late
to five days. If the tenant(s) is/are late three (3) payments during a
one year period all deposits will be forfeited and it is probable that the
lease agreement will not be renewed. Management also has the option of
automatically increasing rents by $25.00 a month and/or serving eviction
notices.

Security
Deposit |
Tenant’s Security Deposit of $___________ will be held in Suntrust Bank
located at Weaver Blvd., Weaverville, NC 28787. Deposit will only be returned 30 days after the tenant vacates, the unit is inspected, and if the following conditions are met: Full terms of the rental agreement
are completed, no damage has been made and all keys have been returned.
There will be a $150.00 cleaning fee on one bedroom units, a $200.00
cleaning fee on 2 bedroom units and a $300.00 cleaning fee on 3 bedroom
units. If stoves, refrigerators or bathrooms are left excessively dirty,
additional charges may be applied. The property manager and the property
manager only, will determine whether the premises will qualify as
acceptably clean. Deposit will be mailed to your new forwarding address.

Written Notices |
Tenant(s) agrees to send all notices to Landlord in writing.
This is the only form of Tenant’s (s’) notice(s) permitted in a
court hearing as evidence of.

Only Agreement |
The Agreement(s) made herein is the only Agreement(s) between the parties. No further Agreement(s) will be honored or considered unless it is
made in writing, signed and executed between the parties.

R
ight of Entry |
Landlord has the right of entry to the Premises with maintenance, law enforcement and real estate personnel after a 24 hour written notice for in-spection, sale of property, re-renting of the unit.

| Law Enforcement |
If law enforcement is called to the unit for Tenant related problem/disturbance, Tenant may be asked to vacate.
|
Personal Property |
We recommend that you insure any and all of your personal property
located in or on the premises. Damage due to fire, storms, theft, electrical surges, and acts of God, are not our responsibility.
|
Pets |
Tenant may may not bring or keep pets in or about the lease premises without the prior written consent of the landlord. If landlord checks
off the “may” bring or keep pets, there will be a $__________ non-
refundable pet fee.

Joint & Several Obligation |
If more than one person executes this Residential Rental Contract as a
Tenant, the obligations of all tenants shall be joint and several with each Tenant assuming full liability for the obligations under this agreement.
|
Default |
If the Tenant(s) violates, breaches or defaults any section of this Agreement landlord may (at landlord’s option) file eviction proceedings without further notice to the tenant(s).
|
Permitted Occupants |
The Tenant shall not allow or permit the Premises to be occupied or used as a resident by another person other than himself/herself and the

Assignment |
The Tenant shall not re-assign this Agreement or sublet the described
Premises in whole or in part.
|
Waiver or Release |
The failure of the Landlord to insist upon strict compliance of the obligations and conditions herein contained shall in no way be construed
to constitute a waiver or release of such obligations and conditions.
|
Rules and Regulations |
The Tenant, his/her family, household employees, guests and agents shall
comply with and abide by all the Landlord’s existing Rules & Regulations
and such future reasonable Rules & Regulations as the Landlord may
from time to time at his discretion adopt, governing the use and
occupancy of the premises and any common areas uses in connection
with them. A copy of the existing Rules & Regulations is attached
hereto and the Tenant acknowledges that he/she has read them. The
Rules & Regulations shall be deemed to be a part of the Agreement and
violations of any of them shall constitute a breach of the Agreement
giving the Landlord all the rights and remedies herein provided. (In the
event of a conflict between the provisions of this Agreement and the
Rules & Regulations, the Rules & Regulations shall govern.)

Rental Application |
In the event the Tenant has submitted a Rental Application in connection
with this Agreement, he acknowledges that the Landlord has relied on
the Application as an inducement for entering into this Agreement and
Tenant warrants to Landlord that the facts stated in the application are true
to the best of the Tenant’s knowledge. If any facts stated in the Rental
Application prove to be untrue the Landlord shall have the right to
terminate the tenancy immediately and to collect from Tenant any damages, including reasonable attorney’s fees, resulting there from.

Duties upon Termination |
Upon termination of the tenancy created hereby whether by the Landlord
or the Tenant and whether for breach or otherwise, the Tenant shall 1) pay
all utility bills due for service to the Premises for which he is responsible
and have all such utility services discontinued, 2) vacate the Premises
removing there from all his personal property of whatever nature. Charges
will be deducted from your deposit if you leave personal items.
3)remove all trash and rubbish, 4) fasten and lock all doors and windows; 5) return to the Landlord the keys to the premises and
6) Notify the Landlord of the address to which the balance of the Security Deposit may be returned, minus the cleaning fee.

Acceptance of Premises |
The Tenant acknowledges that he/she has inspected the Premises and any
common areas used in connection with them are in a safe, fit, and
habitable condition and, where applicable that the electrical, plumbing,
sanitary, heating, ventilating, air conditioning and other appliances
furnished with the Premises are in good and proper working order. The
Tenant also acknowledges that no representation as to the condition or state of repair of the Premises has been made.
